These terms of use (together with the documents referred to in it) tell you the terms of use on which you may make use of our website: https://www.kennedystreetrecovery.org

By using the Kennedy Street Recovery website or the Recovery Connects service, you confirm that you are at least 18 years old, or if you are under 18, that you are using this website or the Recovery Connects service with the consent of your parent or guardian.

Use of our site includes accessing, browsing and accessing links and videos within our site. Please read these terms of use carefully before you start to use our site, as these will apply to your use of our site. We recommend that you save a copy of these terms for future reference. By using our site, you confirm that you accept these terms of use and that you agree to comply with them. If you do not agree to these terms of use, you must not use our site.

These terms of use refer to the following additional terms, which also apply to your use of our site: 

  • Our Privacy policy sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using our site, you consent to such processing and you warrant that all data provided by you is accurate. 
  • Our Disclaimer outlines key information regarding your full responsibility for your health and our role as part of your recovery process. 
  • Use of cookies and our cookies policy Some pages on this website use “cookies”, which are small files that may be placed on your computer’s hard drive for identification purposes. They help us recognise you as a user the next time you visit our website so that our service can be customised for your needs. We also use cookies to compile various statistics relating to the use of the website, such as visits and average time spent on the website. A cookie is sent to your computer and stored as an anonymous tag that identifies your computer but will not personally identify you or read data off your hard drive. You may set your browser to notify you when you receive a cookie, giving you the chance to decide whether or not to accept it. www.kennedystreetrecovery.org is a site operated by Kennedy Street Foundation (“We” / “Our”). Kennedy Street was initially set up as a Community Interest Company in 2016 but was restructured as a charity in April 2020, registered in England and Wales (Charity number: 1189265)

Our legally registered charity name is Kennedy Street Foundation, with registered offices at: 

Bank House, Southwick Square, Southwick, Brighton, BN42 4FN.

4.0 Changes to these terms  

We may revise these terms of use at any time by amending this page. Check this page regularly to take notice of any changes we made, as they are binding on you.

5.0 Changes to our site  

We may update our site from time to time and may change the content at any time. However, please note that any of the content on our site may be out of date at any given time, and we are under no obligation to update it. We do not guarantee that our site, or any content on it, will be free from errors or omissions. 

6.0 Access and use of our site  

Our site is free of charge to access and access is permitted on a temporary basis. We may suspend, withdraw, discontinue or alter any or all of the site without notice at any time. We will not be liable for you should the site or part of the site be made unavailable at any time. It is your responsibility to make necessary arrangements to access our site and you are responsible for ensuring that all persons who access our site through your IP address (internet connection), have read these terms of use, disclaimers, privacy policy and other relevant terms of conditions. 

7.0 Intellectual property rights

We are the sole owners of all intellectual property on this site, and the material published on it and from it. This includes any and all documents downloaded and course material. Those works are protected by copyright and patent law and all rights are reserved. You may print one copy and download any extracts or pages from our site, and draw attention to others within your organisation to our materials should they be relevant. 

You must not alter, modify or change printed or digital copies of any materials. You must not use any photographs, video or audio sequences, illustrations or graphics, separate from any of the accompanying text. Our status and that of identified contributors, as authors of the content on our site, must always be acknowledged. You must not use any content from our site for commercial purposes unless we give you licence to do so. 

If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

8.0 No reliance on information  

We aim to facilitate and guide you through your own recovery process with material within our site but the content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site. Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up-to-date.

Our support & signposting

Our Recovery Connects telephone, support & signposting is provided by trained counsellors, medical professionals, trainee recovery practitioners, Psychology students and trainee Counsellors who are all experienced in the field of recovery from addiction issues. We aim to provide the most suitable support and signposting for the enquiry. However, we can only offer support on the information with which we are provided either by telephone or by email. We do not conduct face-to-face assessments which can be more accurate in diagnosing the severity of a client’s condition. We would therefore always recommend that you visit your Doctor if you deem the condition to be urgent. Calls may be recorded to provide evidence of a business transaction.

Our Network of Treatment Centres

We recommend treatment through a network of private rehabilitation clinics in the United Kingdom and overseas. All the clinics in our United Kingdom network are members of the Care Quality Commission, and our overseas clinics are members of the relevant regulatory authority for their country. Your contract will be with the counsellor and not with Kennedy Street Foundation.

While we may suggest the most appropriate rehabilitation centres for your particular circumstances, we cannot guarantee that treatment will be successful or that you will not relapse in the future.

Our Network of recovery practitioners, therapists and addiction experts

We support and signpost our callers to the most appropriate specialist for your particular needs and circumstances. It is your responsibility to assess if the counsellors you are accessing meet your needs as the customer.  

We may charge the recovery professionals a partnership fee to be a part of our professional referral network, all Kennedy Street Foundation telephone support and signposting is given free of charge to the caller. Thereafter, your contact will be direct with the counsellor. Your contract will be with the counsellor and not with Kennedy Street Foundation. You do not have the statutory right to cancel by notice to us. You may have a statutory right to cancel by notice to the counsellor prior to treatment commencing. We cannot guarantee that your treatment will be successful or that you will not relapse in the future.

Our commitment to you:

  • Advice on free, community recovery projects and private addiction treatment. 
  • An absolute commitment to helping you to find the best value if you are seeking private addiction treatment.
  • A guarantee that you will never pay more for residential treatment than you would by approaching a particular addictions treatment centre directly.

9.0 Limitation of our liability  

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law. To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied. We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:  

  • use of, or inability to use our site; or 
  • use of or reliance on any content displayed on our site, 

If you are a business user, please note that in particular, we will not be liable for: 

  • loss of profits, sales, business, or revenue; 
  • business interruption; 
  • loss of anticipated savings;
  • loss of business opportunity, goodwill or reputation; or 
  • any indirect or consequential loss or damage. 

If you are a consumer user, please note that we only provide our site for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any content on it, or on any website linked to it. 

We assume no responsibility for the content of websites linked to our site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them. Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any goods by use to you, which will be set out in our Terms and Conditions of Supply see below.

10.0 Viruses and Malware

We do not guarantee that our site or linked sites are free from or secure from viruses, bugs or malware. It is your responsibility to configure your devices (information technology, computer programmes and platform) that access our site, in order to access it, and you should use your own virus protection software on your device. You must not access or use our site if you intend to knowingly introduce any virus, malware or related material which would be harmful to technology. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site.

You must not and are unauthorized to attack our site via a denial-of-service attack or a distributed denial-of-service attack (DoS attack). By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. This prohibits, among other offences, unauthorized access to computer material and unauthorized modification of computer material. We will report any such breach to the relevant law enforcement authorities and we will cooperate with those authorities by disclosing your identity and any relevant information to them. In the event of such a breach, your right to use our site will cease immediately.

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link to our site in any website that is not owned by you. Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page. We reserve the right to withdraw linking permission without notice.

If you are a consumer, please note that these terms of use, their subject matter and formation, are governed by English law and fall under the non-exclusive jurisdiction of the courts of England and Wales. If you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland. If you are a business, these terms of use, their subject matter and formation (and any non-contractual disputes or claims) are governed by English law and fall under the exclusive jurisdiction of the courts of England and Wales.
